This electronic system was created to allow the personal representative, or person filing to initiate a proceeding in accordance with the Alabama Small Estates Act, to submit the Notice of Probate electronically.
To submit the Notice of Probate electronically, click the “Submit Electronic Notice” button below. Please note: Fields with asterisks (*) are required. To add contact information for additional individuals (i.e. personal representative, family member, etc.), click the “Add New Person Information” button. Once the form has been successfully submitted, you will be provided a serialized certificate that you can download and save or print. For instructions, please click here.
Submission of an electronic Notice of Probate is not required. To submit a Notice of Probate via certified mail to the Agency, please use the printable version.
The personal representative, or person filing to initiate a proceeding in accordance with the Alabama Small Estates Act, may choose to either provide notice through the electronic system or via certified mail, but shall not be required to do both.
Alabama law (Act 2019-489) requires the personal representative or person filing the small estate case to provide notice of the estate to the Alabama Medicaid Agency.
The Estate Notice Office was created to respond to notices at the commencement of a probate proceeding. This office will process all valid notices within 30 days from the date of receipt.
The electronic notification system was created as an option for the personal representative, or person filing to initiate a proceeding in accordance with the Alabama Small Estate Act, to provide notice to the Agency and shall file the serialized certificate in the probate court if the electronic system is utilized.
